{"id":46345,"date":"2021-01-04T14:13:01","date_gmt":"2021-01-04T06:13:01","guid":{"rendered":"https:\/\/www.imoney.my\/articles\/?p=46345"},"modified":"2024-02-02T15:45:02","modified_gmt":"2024-02-02T07:45:02","slug":"what-constitutes-licensed-investing-advice","status":"publish","type":"post","link":"https:\/\/www.imoney.my\/articles\/what-constitutes-licensed-investing-advice","title":{"rendered":"What Constitutes Licensed Investing Advice?"},"content":{"rendered":"<p>Investment advice is everywhere &#8211; but not all advice is legitimate.<\/p>\n<p>If you&#8217;re getting investment advice (e.g. advice and analysis on specific securities), make sure that your advisor is <a href=\"https:\/\/www.imoney.my\/articles\/advice-licensed-advisor-securities-commission\" target=\"_blank\" rel=\"dofollow noopener noreferrer\">registered and licensed<\/a> with the Securities Commission Malaysia (SC).<\/p>\n<p>However, if you frequently search or contribute to discussion on investment topics, it might not be clear what constitutes investment advice that requires a license. For example, if you discuss a stock on a forum, does that need a license? If you talk about the advantages of <a href=\"https:\/\/www.imoney.my\/articles\/robo-advisor-comparison\" target=\"_blank\" rel=\"dofollow noopener noreferrer\">robo advisors<\/a> on social media, can you get fined?<\/p>\n<p>Recently, the SC has issued a <a href=\"https:\/\/www.sc.com.my\/regulation\/guiding-principles\" target=\"_blank\" rel=\"dofollow noopener noreferrer\">Guidance Note<\/a> on Provision of Investment Advice, which aims to answer these questions. According to the SC, &#8220;recommendations or opinions which are likely to induce a person to take any action or position (e.g. buy, sell or hold) regarding a particular class, sector, or instrument in relation to securities or derivatives, is likely to be considered as &#8216;advising others concerning securities or derivatives'&#8221;. Read the Guidance Note for more information and details on how it relates to specific scenarios.<\/p>\n<p>As an investor, remember to look up the licensing status of any advisor, company or platform before you engage with them. To do so, check the Public Register of License Holders <a href=\"http:\/\/www.sc.com.my\/licensed-registered-persons\" target=\"_blank\" rel=\"dofollow noopener noreferrer\">www.sc.com.my\/licensed-registered-persons<\/a> and List of Registered Recognised Market Operators <a href=\"http:\/\/www.sc.com.my\/rmo\" target=\"_blank\" rel=\"dofollow noopener noreferrer\">www.sc.com.my\/rmo<\/a>.
